Agreement to Terms

Welcome to Who Shot That Media. By accessing or using our website at whoshotthatmedia.com, submitting any form, booking a consultation, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms constitute a legally binding agreement between you and Who Shot That Media.

Services

Who Shot That Media provides professional video production, photography, and drone footage services to clients in the Louisiana and Gulf South area. Our services include but are not limited to:

• Cinematic video production
• Professional HDR photography
• Drone and aerial footage
• Virtual 3D tours
• Social media content creation
• Event coverage and documentation
• Music and entertainment video production.

The specific deliverables, timeline, and pricing for each project are determined on a per-project basis and will be outlined in a separate project agreement or quote provided to the client before work begins.

Quotes and Pricing

All quotes provided by Who Shot That Media are valid for 30 days from the date issued unless otherwise stated. Prices are subject to change based on project scope, location, scheduling requirements, and any additional services requested beyond the original quote. Final pricing will be confirmed before any work begins. All prices are listed in US dollars.

Booking and Scheduling

By booking a consultation or scheduling a shoot through our website or by contacting our team directly, you agree to the following:

• You will provide accurate contact information and project details
• You will be available at the agreed-upon date, time, and location
• You will provide reasonable access to the shoot location and any necessary permissions
• You will communicate any special requirements or restrictions prior to the shoot date.

Cancellation and Rescheduling

We understand that plans change. Our cancellation and rescheduling policy is as follows:

• Cancellations made 48 or more hours before the scheduled shoot will receive a full refund of any deposit paid
• Cancellations made less than 48 hours before the scheduled shoot may be subject to a cancellation fee
• Rescheduling requests made 24 or more hours in advance will be accommodated based on availability at no additional charge
• No-shows without prior notice will forfeit any deposit paid.

Payment Terms

Payment terms are as follows:

• A deposit may be required to secure your booking depending on the project scope
• Final payment is due upon delivery of completed content unless otherwise agreed in writing
• We accept all major credit cards, debit cards, and bank transfers
• Late payments may be subject to additional fees
• Memberships are billed monthly and can be cancelled with 30 days notice.

Content Delivery and Usage Rights

Upon full payment, clients receive the following rights to all content produced by Who Shot That Media:

• Full commercial usage rights for all delivered photos, videos, and media
• Permission to use content on MLS, materials, presentations, and any other marketing channels
• Content is delivered digitally via cloud platforms such as Dropbox or Google Drive
• Standard delivery time is within 48 hours of the shoot unless rush delivery is arranged.

Who Shot That Media retains the right to use completed work in our portfolio, website, social media, and marketing materials for promotional purposes unless the client requests otherwise in writing before the shoot.

Revisions

We want you to be completely satisfied with your content. Most projects include a set number of revision rounds as outlined in your quote or package details. Revisions beyond the included rounds may be subject to additional fees. Revision requests must be submitted within 14 days of content delivery. After 14 days, the deliverables are considered accepted and approved by the client.

Intellectual Property

All raw footage, source files, and working project files remain the property of Who Shot That Media unless otherwise agreed in writing. Clients receive the final edited and delivered content with full usage rights as described in the Content Delivery and Usage Rights section above. Clients may not resell, sublicense, or distribute the content as a standalone product.

Limitation of Liability

Who Shot That Media is fully licensed and insured. However, to the maximum extent permitted by law:

• Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question
• We are not liable for any indirect, incidental, consequential, or punitive damages
• We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control including but not limited to weather, equipment failure, acts of God, or client-caused delays
• We are not responsible for how engaging our services, you agree to:
• Provide accurate information when submitting forms or booking consultations
• Ensure the shoot location is accessible, safe, and available at the scheduled time
• Obtain any necessary permissions or permits for the shoot location
• Communicate any specific requirements, brand guidelines, or restrictions before the shoot
• Review and provide feedback on deliverables within the revision window.

Website Use

By using our website you agree to:

• Use the website only for lawful purposes
• Not attempt to gain unauthorized access to any part of the website
• Not submit false or misleading information through any form
• Not interfere with the proper functioning of the website.

We reserve the right to modify, suspend, or discontinue any part of our website at any time without notice.

Privacy

Governing Law

In the event of any dispute arising from these Terms of Service or our services, the parties agree to first attempt to resolve the matter through good faith negotiation. If a resolution cannot be reached, the dispute shall be resolved through mediation or arbitration in accordance with the laws of the state where the services were performed. These Terms of Service shall be governed by and construed in accordance with the laws of the relevant jurisdiction within the Louisiana / Gulf South area.

We may update these Terms of Service from time to time. When we make changes, we will update the 'Last Updated' date at the top of this page.
